Roads End Challenges Annexation

After the Lincoln City City Council formally decided to officially annex the Roads End area into the city December 10th, the Roads End Water District began their legal challenge.  The group has filed an appeal to the state Land Use Board of Appeals (LUBA).

LUBA Appeal:
The text of the appeal has not yet been published but the title describes it as an appeal of an ordinance annexing the Roads End area to the City of Lincoln City. Interested parties can search the LUBA website for Roads End Water District v. City of Lincoln City, LUBA No. 2012-101, which was filed December 28, 2012.

Roads End Residents Need Your Help

Grant Application Deadline is June 30

The residents of Roads End are developing their own water system that once complete will serve over 800 people in Roads End. You can help and it won’t cost anything but a few minutes of your time. The Roads End Water District (REWD)  has signed up for a $250,000 small business grant from Chase Bank.  It needs at least 250 people to sign in though Facebook and show support for REWD in order to qualify. All you need is a Facebook account.  Anyone with a Facebook account can vote and they have managed to get quite a few votes. The deadline is Friday, June 30. Whether they get the grant or not, its a great way for one part of our community to help another.

Roads End Lawsuit Threat Gathers Pace

Lincoln City leaders have received another batch of warnings from Roads End residents that shutting off their water supply will lead to a court battle.

Members of the Roads End Water District appeared at Lincoln City Council’s March 12 meeting to deliver 37 new tort claim notices from Roads End property owners, all of whom have threatened to sue the City for damages if the City follows through on a threat to shut off their water.

Parties Silent On Water Talks

Neither side is saying much about an 11th-hour meeting between Lincoln City officials and members of the Roads End Water District, which took place
on Dec. 8.

The District requested the meeting on Nov. 28 as the City was on the cusp of sending out letters to Roads End property owners demanding that they consent to annexation in exchange for continued water supply.

City Manager David Hawker confirmed that he and Mayor Dick Anderson met with two members of the District’s board of directors, describing the talks as “cordial” but “uneventful.” Continue reading

Lincoln City Agrees to Roads End Water Talks

With letters demanding Roads End annexation consent poised to leave Lincoln City Hall any day, city councilors have agreed to a last-minute meeting with members of the Roads End Water District to discuss the supply of water to the area.

Mayor Dick Anderson said he and City Manager David Hawker would make themselves available to meet with a delegation from the District’s board of directors as early as this week. Continue reading

City’s water demands decried as ‘hostage’ tactics

After several false starts, Lincoln City is set to proceed with the final phase of its effort to gather enough annexation consents from Roads End property owners to bring the area inside the city limits.

At its Oct. 24 meeting, Lincoln City Council directed staff to send letters to all Roads End property owners who have not yet consented to annexation, giving them 60 days to do so or face having their water shut off. Continue reading

City Puts The Squeeze on Roads End Residents

Residents Resist; City Ratchets Water Service

The residents of Roads End recently received a positive Initial Review of their application to drill six wells which will become the new source of water for the reformulated Roads End Water District (REWD).  Also this week Lincoln City Council passed a resolution to direct the city manager to send 60-day notices to Roads End area residents requiring signed agreements consenting to annexation in order to receive continued water service. Roads End hopes to drill down on issue

Groups say water supply could ensure independence

In an effort to resist annexation by Lincoln City, groups in Roads End are looking at drilling six wells in the area to create an independent water system.

Although the elected Roads End Water District (REWD) is spearheading the plan, supporters of the project are urging property owners to make donations to a private company run by one of the District’s directors.

One fundraising email, sent on Aug. 24 from the local nonprofit Roads End Improvement Association (REIA), asks residents to donate to the Keizer-based Roadsend Group, LLC, to fund “Engineering, Geologic, as well as legal” projects to fight annexation.

On Sept. 10, Roadsend Group founder Chuck Jacobsen sent a fundraising email that contained a statement from REWD President Maud Krom announcing the well plan.

Krom’s message did not include any request for donations, but Jacobsen’s portion of the email, which also referred to legal efforts to oppose annexation, asked for donations to the LLC. Continue reading

Roads End Water District Seeks Water Rights

In an announcement released this week by Maud Krom, the President of the Roads End Water District stated that the District’s intention is to locate a  “secure & unthreatened water supply and discontinue service from Lincoln City.”  She further explained that this action was a direct response to the efforts of the City of Lincoln City to annex the area using the threat of water shutoff to obtain consent to annex agreements from area residents. The text of the announcement was as follows.

ANNOUNCEMENT

The Roads End Water district, in conjunction with The Roads End Improvement Association and The Roadsend Group LLC, is pleased to announce that the Roads End Water District has made application for water rights in the Roads End Community with the State of Oregon Water Resources Dept.

The end goal is to establish our own water system independent of any third party, that is a safe , secure & unthreatened water supply and discontinue service from Lincoln City.

The Water District board of directors have completed an extensive study into costs, system feasibility, and logistics and found it practical to pursue this solution to meet the needs of The Roads End Community.

We can no longer rely on Lincoln City to serve our needs in the future. The City has made it clear that they are willing to shut off water to our residents and stated publicly that their supply is limited. Lincoln City has placed those property owners who signed “consent” to annex forms in jeopardy. By signing the City form they signed away their right to uninterrupted water service, as the fine print in the consent forms essentially allow Lincoln City to unilaterally shut off water at any time for any reason–even after annexation and even if your bill is paid in full–without recourse. Lincoln City has essentially placed a moratorium on building on vacant lots or land. This renders those sites virtually unbuildable and of little value, thereby harming our community members. Bill Could Help Roads Enders’ Case

Some Roads End residents have welcomed a proposed bill that would outlaw the tactics endorsed by Lincoln City Council to gather annexation consents from the area’s property owners.

The bill, sponsored by state Rep. Kim Thatcher (R-Keizer) would make it illegal for a city or district to require a property owner to consent to annexation in exchange for continuation of an existing service, such as water. Continue reading
